Event Terms and Conditions

Application to Participate in Driving Event

I request permission to enter the track to attend and take part in the driving Event, utilizing the vehicles, facilities and track offered by Vision Driver Training. Participation in the Event may include operating a Vehicle, being a passenger in a Vehicle, and being near race cars, equipment, tools, fuel, and other motor racing-related materials. Vision Driver Training grants me access to the track for the Event solely under the terms and conditions outlined in this Agreement.

Definitions

In this Agreement:

• “Activities” means any motor vehicle driving, training, instruction, or other activities conducted at the Facility.
• “Company” means Vision Driver Training ABN 96327528800, its partners, employees, instructors, agents, and representatives.
• “Facility” means any track, circuit, or venue where the Activities are conducted.
• “Facility Owner” means the owner and/or operator of the Facility and their respective directors, employees, agents, and representatives.
• “Vehicle” means any motor vehicle used in the Activities, whether provided by the Company or the Participant.
• ”Event” means the Activities offered by the Company at the designated Facility

Agreement

I acknowledge that my participation in the Event is strictly subject to the following terms:

Driving Can Be Dangerous

I understand that driving a motor vehicle, being a passenger in a vehicle, or being near vehicles during the Event can be dangerous. Participation in the Activities involves inherent risks, including but not limited to:

• Serious injury or death.
• Collision with vehicles, objects, or persons.
• Vehicle damage or loss.
• Equipment failure.
• Track conditions.
• Actions of other participants.
• Weather conditions.

Risk of Injury, Death, or Property Damage

I understand that participating in the Event carries risks, including physical or mental injury, trauma, illness, property damage, or even death. Accidents can and do happen, and I accept these risks.

Acceptance of Risk

I voluntarily and fully accept all known and unknown risks associated with the Event, including all consequences of these risks.

Voluntary Participation

I am attending the Event by my own choice. My participation is not required by my employer or any other organization, and I have not been induced to participate or agree to these terms.

Care and Caution

I agree to exercise a high degree of care and caution for my own safety and the safety of others, including participants, officials, employees, contractors, spectators, and road users, at all times during the Event.

Follow Directions

I agree to follow all instructions given by Vision Driver Training, its instructors, officials, employees, contractors, and agents. I understand that these directions are provided without any warranty to me. I understand that failure to do so may result in my immediate exclusion from the event and activities.

Safe Driving and Behavior

I agree not to drive any vehicle in a competitive or unsafe manner during the Event. If I am a passenger, I will not distract the driver or act unsafely.

No Existing Medical Conditions

I declare that, as of today, I am not aware of any medical condition (including pregnancy, physical or mental illness, disorder, or disease) that may affect my ability to participate in the Event. If such a condition exists, I agree to inform Vision Driver Training. Participation after disclosure is at my own risk.

Release of Liability

I release and hold harmless Vision Driver Training, the track, and their officers, employees, contractors, sponsors, promoters, and organizers from all liability for any injury, illness, trauma, death, or property damage arising from my participation in the Event.

Indemnity

I indemnify and will keep indemnified Vision Driver Training, the track, and their officers, employees, contractors, sponsors, promoters, and organizers against all losses, claims, damages, or expenses resulting from my actions, conduct, or behavior during the Event.

Duty of Care

I accept that Vision Driver Training and its associated parties are not liable for personal injury resulting from the risks of dangerous recreational activities, as outlined in applicable Australian state and territory laws related to civil liability, including negligence, personal injury claims, and damages. I acknowledge that some risks have been forewarned.

Australian Consumer Law

I accept that Vision Driver Training will comply with the Australian Consumer Law regarding the supply of goods and services, including providing services with proper care and skill.

Exclusion of Warranties

To the extent permitted by law, any express or implied warranties are excluded from this Agreement. I confirm that the goods and services provided are not for personal, domestic, or household use.

Limitation of Liability

If Vision Driver Training or its associated parties are found liable to me, their liability is limited to the cost of re-supplying the goods or services.

No Legal Proceedings

I agree not to initiate or allow legal proceedings against Vision Driver Training or its associated parties, except for claims as detailed in Limitation of Liability (if applicable).

No Warranties Provided

I acknowledge that no warranties, express or implied, have been made to me regarding the services provided.

Photographs and Video

I agree that photos and videos of me and my vehicle may be taken during the Event. These images are the property of Vision Driver Training and the photographer and may be used for promotions, social media or advertising. If I do not consent, I will inform the instructor and photographer on the day.

Damage to Track, Facilities, or Vehicles

I agree that I may be held financially responsible for any damage caused to the track, facilities, or vehicles as a result of my participation in the Event.

**Governing Law

This Agreement shall be governed by the laws of the New South Wales and the Commonwealth of Australia.

Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remainder shall remain in full force and effect.

Participant Acknowledgement

I have read this Agreement carefully and understand its contents. I acknowledge that this Agreement affects my legal rights and obligations. I sign it freely and voluntarily without any inducement.
